Preview of Coaching Agreement

This agreement is made today between Melissa McGrath (the Health Coach), and the Client (insert contact information).

SERVICES: Health coaching is a relationship of respect between Health Coach and Client. Health Coach & Client will co-explore the topics, challenges, concerns, changes and successes of health & wellness in this integrative and holistic program. The approach will be to utilize Client strengths and values with coaching strategies to move toward greater health and wellness. The Program in which you are about to enroll in will include the following:

1. Four weekly virtual coaching sessions (each 60 minutes long)

2. One final virtual coaching session (30 minutes long)

3. Course including 6 modules with lessons and supporting materials related to health, behavior change, and motherhood

4. Messaging access to Health Coach for five weeks (starting from Session One and ending at Session Five)

SCHEDULING: As the Health Coach, I take pride in not keeping busy clients waiting or longer than planned. Please be on time. If the Client needs to cancel or reschedule a session, the Client must do so twenty-four (24) hours in advance in writing/email; otherwise, the Client will forfeit the session (unless otherwise determined at the sole discretion of the Health Coach). If session is split into two (2) one-hour sessions, both will be scheduled on a weekly basis at the same day and time each week.

PAYMENTS AND REFUNDS: The cost of the Program is nine hundred and ninety-nine dollars ($999) and is a one-time full payment. Payment can be made by Credit Card online. In the event of the Client’s absence or withdrawal, there will be no refund issued. The Health Coach reserves the right to cancel the Program at any point if it is not advantageous to continue. If this happens, the Client is responsible for the pro rata share of coaching services received.

ROLES: The Client understands that the role of a Health Coach is not to prescribe, provide medical care, to diagnose, to treat or to cure any disease and/or condition of the physical or mental condition of the human body. Rather, the Health Coach is a mentor who has been trained in holistic nutrition and wellness coaching to motivate & empower clients to reach their health goals via positive, sustainable lifestyle changes. The Client understands that the Health Coach is not acting in the capacity of a doctor or psychologist, and that any advice given by the Health Coach is not meant to take the place or advice by these professionals. The Client should discuss any dietary changes or potential dietary supplements use with his or her doctor, and should not discontinue any prescription medications without first consulting his or her doctor. The Client has chosen to work with the Health Coach and understands that the information received should not be seen as medical advice and is not meant to take the place of seeing other licensed health professionals.

PERSONAL RESPONSIBILITY AND INDEMNITY: The “Program” refers to Health Coaching Services administered by the Health Coach. Some associations may offer incentives for Client referrals. The Client acknowledges to take full responsibility for the life and well-being of the Client (and family/children where applicable), including all related decisions made during & after this Program. The Client expressly assumes the risks of the Program, including the risks inherent of trying new foods, or lifestyle changes. The Client releases the Health Coach from/against any and all liability, damages, causes of action, allegations, suits, sums of money, expenses, claims and demands whatsoever, in law or equity, which the Client ever had, now has or will have in the future against the Health Coach arising from (i) the Client’s past or future participation in the Program or other programs; (ii) the acts or omissions of Coach in connection with the Program or other programs; or (iii) any accident, injury or death to persons, or loss of or damage to property, or fines and penalties which may result in whole or in part, by reason of the Program or other programs.

CONFIDENTIALITY: The Health Coach will keep the Client’s information private, and will not share the Client’s information unless the Client has provided written permission to share, or unless someone’s life is at risk, or unless compelled to by law. A Privacy Policy document will be given to the Client for further clarity of this topic.

ARBITRATION, CHOICE OF LAW, AND LIMITED REMEDIES: In the event that there ever arises a dispute between Health Coach and Client with respect to the Services provided pursuant to this agreement or otherwise pertaining to the relationship between the parties, the parties agree to submit to binding arbitration before the American Arbitration Association (Commercial Arbitration and Mediation Center for the Americas Mediation and Arbitration Rules). Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Such arbitration shall be conducted by a single arbitrator. The sole remedy that can be awarded to the Client in the event that an award is granted in arbitration is refund of the Program Fee. Without limiting the generality of the foregoing, no award of consequential or other damages, unless specifically set forth herein, may be granted to the Client. This agreement shall be construed according to the laws of the State of Texas. In the event that any provision of this Agreement is deemed unenforceable, the remaining portions of the Agreement shall be severed and remain in full force.

EMERGENCY: The Client is providing an emergency contact to be reached ONLY in the event of an emergency (insert emergency contact)

If the terms of this Agreement are acceptable, please sign the acceptance below. By doing so, the Client acknowledges that: (1) he/she has received a copy of this letter agreement; (2) he/she has had an opportunity to discuss the contents with the Health Coach and, if desired, to have it reviewed by an attorney; and (3) the Client understands, accepts and agrees to abide by the terms hereof.
